Terms and Conditions of the Online Store DRAMAT Europe

This document establishes the rules for providing free services and selling products via the online store http://dramateurope.com/ (hereinafter referred to as the "Online Store" or the "Store"), operated by Marlena Kiełbus, conducting business under the name DEU STUDIO Marlena Kiełbus, NIP: 5342392454, REGON: 540521672.

[Definitions]

  • §1

  1. Terms used in the regulations mean:
  1. Regulations – these terms and conditions,
  2. Seller – Marlena Kiełbus, conducting business under the name DEU STUDIO Marlena Kiełbus, ul. Sułkowskiego 46, 05-820 Piastów, NIP:5342392454, who owns the store,
  3. Online Store Website/Online Store – the website operating under the domain dramateurope.com, through which the Seller conducts online sales,
  4. Customer – a natural or legal person using the Online Store website, including the person who has registered an account and places an order through the Online Store under the terms specified in these Regulations,
  5. Account – a customer panel managed by the Store, activated after completing the registration process, on which information about order history and receipts is stored,
  6. Registration – the process of creating an Account,
  7. Agreement – a distance sales contract concluded between the Customer and the Store, under the terms specified in these Regulations, concerning the goods offered in the Online Store,
  8. Business Day – any day from Monday to Friday, excluding statutory holidays,
  9. Consumer – a natural person who performs a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
[General Principles]
  • §2
  1. To use the Online Store, the Customer must have access to a device connected to the Internet, an updated version of the Microsoft Edge, Internet Explorer, Google Chrome, Mozilla Firefox, Opera, or Safari browser with JavaScript and Cookies enabled, and an active email account.
  2. Customers are not authorized to use other customers' accounts. Customers may not share their Account with other customers.
  3. The Customer is prohibited from posting unlawful content via their Account.
[Registration and Account Management]
  • §3
  1. To place an order, it is necessary to correctly fill out the order form, which is available to the Customer after adding a product to the cart.
  2. An order can be placed by a logged-in user, i.e., a user who has completed the Registration process and has a registered Account. The Registration process can be completed during the shopping process in the Online Store.
  3. To create an Account, the following information must be provided in the registration form:
    1. email address,
    2. first name,
    3. last name,
    4. mailing address,
    5. phone number.
      Information required for account creation and order processing are clearly marked in the registration form. Information on the processing of the Customer's personal data is available in the "Privacy Policy" section.
  4. After filling out and submitting the registration form, a confirmation message will be sent to the Customer's email address.
  5. The service of maintaining the Account, provided by the Seller, is free of charge. A contract for the provision of this service for an indefinite period is concluded when the Customer receives the confirmation message mentioned in paragraph 4 above.
    At any time, the Customer has the right to terminate this agreement by submitting a statement or request to delete the Account. To terminate the agreement for maintaining the Account, an email should be sent to: dramatinfo@gmail.com. If the termination of the agreement occurs while the Seller is processing an order placed by the Customer and accepted by the Online Store, the termination will take effect upon the completion of that order. The data of the Customer who has terminated the agreement for maintaining the Account will be deleted, unless their processing is necessary for the purposes of pursuing claims.
[Placing Orders]
  • §4
  1. The information provided on the Website is not an offer within the meaning of the Civil Code but merely an invitation for Customers to submit offers to conclude an Agreement.
  2. Orders in the Online Store can be placed 7 days a week, 24 hours a day.
  3. The Customer places an order by adding the product to the cart. The Customer selects the quantity of the product, its size, and, if the product is available in multiple colors, the color.
  4. The Customer has the option to verify the products added to the cart, change their sizes, quantities, or color, or remove them from the cart. The Customer can also check the total price, including shipping costs, and add discount codes before completing the transaction.
  5. At this stage, the Customer can either proceed to checkout or continue shopping and add more products to the cart.
  6. After clicking the "PROCEED TO CHECKOUT" button, the Customer can complete the purchase by logging into their Account or starting the Registration process and then logging into the newly created Account.
  7. In the next step, the Customer provides the delivery address for the order if desired. The Customer selects the delivery method and is informed about the delivery costs. After verifying the total cost of the order, including all possible taxes, the Customer places the order by clicking the "Order and Pay" button.
  8. Before submitting the order, the Customer confirms that they have read the Regulations and accept the provisions contained therein. The Customer can download the Regulations and save them to their computer.
  9. The correctness of the completed purchase forms is confirmed in the order summary. If online payment is selected, the confirmation also includes information about the order number, the email address provided by the Customer, where information about the order, including the tracking code and the possibility of logging into the account and tracking the order status, will be sent.
  10. Placing the order constitutes the Customer's offer to conclude the Agreement.
  11. After receiving the order, the Seller promptly sends a confirmation of the order to the email address provided by the Customer.
  12. After accepting the order for processing, the Seller promptly sends an email to the Customer informing them about the stage of the order's processing. This information constitutes the Seller's declaration of acceptance of the Customer's offer. The Agreement is concluded when the Customer receives the information from the Seller.
  13. The Customer will be informed about the changing status of the order (e.g., "shipped") via an email sent to the email address provided during registration.
  14. The order processing time is generally up to 14 working days from the date the order was placed by the Customer and the payment is credited to the Seller's account. If a longer processing time is necessary for the order, the Seller will inform the Customer via email.
  15. In the event of product unavailability or other issues with order fulfillment, the Seller will contact the Customer to determine the method and time of fulfillment or the conditions for withdrawal from the contract.
[Payments and Delivery]
  • §5
  1. Sales in the Online Store are generally conducted in Polish zloty (PLN). If other currencies are available, this will be clearly visible on the Online Store's website.
  2. The value of the products listed on the product page will be increased by the delivery costs depending on the chosen delivery method. The delivery cost is indicated during the order process, and the Customer is informed of it before completing the transaction.
  3. Orders are processed within Poland. If international shipping is available, this will be indicated on the Online Store's website.
  4. Deliveries are carried out via Polish Post, Pocztex, or Inpost. The Customer selects the delivery method for the purchased product.
  5. In case of ordering multiple products, the shipping cost is the same as for a single product order.
  6. Before receiving the parcel from the courier, the Customer should check if the packaging of the purchased product has been damaged during transport. If the packaging is damaged, the Customer may prepare a damage report in the presence of the courier. The Customer should then contact the Online Store immediately.
  7. When placing an order, the Customer may choose one of the following payment methods:
    1. Bank transfer – after placing the order, the Seller promptly sends the Customer information about the bank account number, transfer amount, and payment title via email. The Customer makes a direct payment to the Seller's bank account before the product is shipped.
    2. Online transfer – the order is processed by the payment service provider, such as Przelewy24, PayPal, or other payment methods available in the Online Store.
  8. The Customer is obligated to make the payment for the order within 3 working days from the date of concluding the Agreement.
  9. The delivery time for products within Poland is up to 3 working days. Delivery to international addresses takes up to 15 working days.
  10. Each order is accompanied by a relevant accounting document.

[Right to Withdraw from the Agreement]
  • §6
  1. The Customer who is a Consumer has the right to withdraw from the Agreement without providing any reason within 14 days from the date of receiving the product, by submitting a clear statement to this effect (e.g., a letter sent by post or email).
  2. To meet the deadline for withdrawal from the Agreement, the Customer should send a statement regarding the withdrawal before the expiration of the 14-day period.
  3. The Customer may withdraw from the Agreement using the model withdrawal form available on the Online Store's website or send a separate written statement. The form can be found at the end of these Regulations.
  4. In the event of withdrawal from the Agreement, the Seller will return all payments received from the Customer, including the costs of delivery (except for additional costs resulting from the choice of a delivery method other than the least expensive standard delivery offered by the Seller), immediately, and in any case, no later than 14 days from the date on which the Seller was informed of the Consumer's decision to withdraw from the Agreement. The Seller will return the payment using the same payment method that was used by the Customer, unless the Customer explicitly agrees to another method of return.
  5. The Customer is obliged to return the product to the Seller within 14 days from the date of withdrawing from the Agreement, at their own expense. The product should be returned unused and in its original packaging, unless it was damaged through no fault of the Customer.
  6. The right to withdraw from the Agreement is excluded in the case of:
    1. Products that are custom-made or personalized at the Customer's request,
    2. Products that are delivered in sealed packaging and are not suitable for return due to health protection or hygiene reasons, if the packaging was opened after delivery,
    3. Products that, due to their nature, are inseparably mixed with other products after delivery.
[Warranty and Complaints]
  • §7
  1. The Seller is liable to the Customer for the product's conformity with the Agreement under the warranty for defects for a period of 2 years from the date of delivery.
  2. In the event of a product defect, the Customer has the right to file a complaint and request that the product be replaced with a product free from defects, or that the defect be removed. The complaint can be submitted to the Seller's email address or the postal address of the Seller.
  3. If the product is defective, the Customer has the right to demand a reduction in the price, a replacement with a defect-free product, or the withdrawal from the Agreement.
  4. In the case of submitting a complaint, the product should be returned to the Seller in its original packaging, along with the proof of purchase. The Seller will inform the Customer about the manner of dealing with the complaint within 14 days from the date of receiving the complaint.
  5. If the product is replaced or repaired, the warranty period is extended by the period during which the product was out of the Customer's possession due to the complaint.
  6. If the complaint is accepted, the Seller will repair the defect or replace the product with a new, defect-free one at no additional cost to the Customer.
[Personal Data Protection]
  • §8
  1. The Seller processes personal data of the Customer in accordance with applicable law, including the provisions of the General Data Protection Regulation (GDPR).
  2. The personal data of the Customer is processed for the purposes of order fulfillment, sending marketing information (if the Customer has given their consent), and responding to inquiries or complaints.
  3. The Customer has the right to access their data, correct it, delete it, or request the limitation of its processing.
  4. Personal data is processed and stored by the Seller for as long as necessary for the performance of the contract and for the purposes of fulfilling legal obligations.
  5. For more detailed information on personal data protection, the Customer can read the Seller's Privacy Policy, which is available on the Online Store's website.
[Final Provisions]
  • §9
  1. These Regulations are effective from the moment of their publication on the Online Store's website.
  2. The Seller reserves the right to amend the Regulations. The amendments will be effective from the moment of their publication on the website, provided that they do not affect the rights acquired by the Customer before the amendments were introduced.
  3. In matters not regulated by these Regulations, the provisions of Polish law shall apply, including the Civil Code and the Act on Consumer Rights.
  4. The Seller will not be held liable for any delays or failure to perform the Agreement caused by force majeure events, such as natural disasters, acts of terrorism, and other similar circumstances.
  5. In the event of disputes between the Seller and the Consumer, the court competent for the Consumer's place of residence will be the competent court.

Model Withdrawal Form

If the Customer wishes to withdraw from the Agreement, they should complete and send the following form:
